exhaust position

I am in the process of mounting a pannier rack, but have problems with contact between exhaust and the rack. It seems like the exhaust is located pretty far away from the bike. Has anyone else had this problem?

I have the stock Yamaha panniers. Dealer installed them. Exhaust clearance is good. I believe they're Givi. Right side box is indented to accommodate muffler. The rack bent outward as well.
